If we talk about the professions of lawyers, attorneys or solicitors, basically both of these parties provide legal services. However, in the past, there were differences depending on where these two terms were practiced.

Under the decree of the Ministry of Justice, lawyers can provide legal services in court and conduct proceedings throughout Indonesia. On the other hand, a license to practice law is granted only in district courts. In other words, the scope of the attorney’s work is more limited than that of the attorney.

To proceed outside the area where the attorney is licensed to practice, the attorney must seek permission from the court in which he intends to provide legal services.

Since Law No. 18 on Advocates was passed in 2009, there is now no difference between Advocates and Lawyers. According to Article 1 (1) of the Attorneys Act, all persons who have a profession of providing legal services both inside and outside the courts throughout the Republic of Indonesia are called defense attorneys, including lawyers.

How do lawyers work?

While information about lawyers, advocates, or the profession of attorney is common, there are still many people who do not fully understand how lawyers work. The paradigm that exists in the wider community is that the Advocate’s job is to free their clients from litigation. Of course, this paradigm is incorrect.

According to the Secretary General of the National Guidance Department of the Indonesian Bar Association (PERADI), an attorney’s duty is to provide legal assistance to clients to obtain their rights during the legal process.

Indeed, attorneys are free to make statements and opinions while defending their clients’ cases in court, as long as they comply with the codes of professional ethics and the laws and regulations.

In addition, all attorneys are obliged to keep all information about their clients confidential, except as otherwise provided by law. One more thing, an attorney or defense attorney is prohibited from discriminating against a client based on religion, politics, gender, race, or social and cultural background.

Requirements to Become a Lawyer

According to Article 2, Paragraph 1 of the Attorney Law, a person who can become a lawyer is a person who has majored in law. In addition, it is compulsory to complete special education for the profession of attorney organized by the Indonesian Bar Association (PERADI).
After completing special training for the bar profession, you must take an exam and do an internship in a bar office for approximately two consecutive years. If you pass, you will be sworn in according to your residence in the High Court before acting as an attorney.

4 Qualities a Good Lawyer Should Have

A good lawyer is not only judged on how cleverly he or she masters applicable theories and laws, but must also have the following five qualities:

1. Persuasive

When solving cases in court, lawyers must be persuasive. The goal is to convince the court of the client’s position.

2. Can Negotiate Well

The second quality a lawyer should possess is negotiating ability. Bargaining skills are useful in reaching good agreements between the parties involved.

3. Can Control Emotions

Not all exams always go smoothly. Lawyers often face arguments or threats that affect their feelings. So, a good lawyer is someone who has the ability to control their emotions well.

4. Have a Patient Attitude

Finally, lawyers need to be patient as it usually takes several months for some cases to be finally resolved.
